These Terms and Conditions govern the use of the Website and purchases made through the Da Luz online store.
By browsing the Website or placing an order, the user declares that they have read, understood and accepted these Terms and Conditions.
If the user does not agree with these Terms, they must not use the Website or place an order.
These Terms apply without prejudice to the rights granted to consumers under applicable Portuguese and European legislation.
3. Use of the Website
The user agrees to use the Website responsibly, in accordance with the law and without impairing its operation, security or the rights of third parties.
The following are not permitted:
- using the Website for fraudulent or unlawful purposes;
- providing false, incomplete or third-party information without authorisation;
- introducing viruses, malicious programs or other technologically harmful elements;
- attempting to gain unauthorised access to the Website, its servers or systems;

- placing orders intended for unauthorised resale.
Da Luz may limit or suspend a user’s access where there are indications of fraud, abusive use or breach of these Terms.

The customer is responsible for:

- keeping their password confidential;

Da Luz shall not be liable for losses resulting from the misuse of an account where such misuse results from the customer’s failure to comply with their security obligations.
5. Products
Whenever applicable, the products displayed on the Website are accompanied by photographs, descriptions, prices, dimensions and other relevant characteristics.
We endeavour to present products as accurately as possible. However, there may be minor differences between the colours displayed on the screen and the actual colours, depending on the device, lighting, monitor settings or the product’s own characteristics.
Photographs are illustrative and do not replace the description and characteristics provided on the product page.
The measurements provided are approximate and minor variations may occur as a result of the manufacturing process.
Product availability is subject to existing stock. Adding a product to the shopping cart does not constitute a stock reservation.
6. Pre-orders
Certain products may be made available on a pre-order basis before they are available for immediate dispatch.
The relevant product page will indicate, whenever possible, the estimated dispatch date or period.
Pre-order dates are estimates and may change due to production, supply, transport, customs clearance or other events beyond Da Luz’s reasonable control.
When an order includes both available products and pre-order products, the order may only be shipped once all products are available, unless a separate shipment is agreed. A separate shipment may involve additional costs.
If a significant delay occurs, the customer will be informed and may choose to keep or cancel the pre-order product. In the event of cancellation, the corresponding amount will be refunded.
7. Orders
To make a purchase, the customer must:
1. select the desired products;
2. indicate the quantities;
3. add the products to the shopping cart;
4. provide the information required for invoicing and delivery;
5. choose the delivery method;
6. select the payment method;
7. review and confirm the order.
Before completing the purchase, the customer must carefully check the products, quantities, prices, discounts, contact details and addresses.
After the order is submitted, a confirmation will be sent to the email address provided by the customer.
Automatic confirmation of receipt does not prevent the cancellation of an order in situations such as:
- lack of stock;
- an obvious error in the price or description;
- inability to validate the payment;
- reasonable suspicion of fraud;
- inability to deliver to the indicated destination;
- a technical error affecting the order.
If a paid order cannot be accepted, the amounts received will be refunded using the same payment method, unless expressly agreed otherwise.

The prices displayed on the Website are stated in euros and include VAT at the legally applicable rate, where applicable.
Delivery costs, additional fees and any discounts are shown before the order is confirmed.
Da Luz may change prices at any time. Such changes shall not affect orders that have already been confirmed, except in the event of an obvious error.
If an obvious error is identified in the price of a product, the customer will be informed and may confirm the purchase at the correct price or cancel the order and receive a full refund of the amounts paid.
For deliveries to European countries that are not members of the European Union, customs duties, import taxes, customs clearance fees or other local charges may apply. Unless expressly stated otherwise, these charges are the recipient’s responsibility.
9. Promotional Codes and Discounts
Promotional codes are subject to the conditions communicated when they are issued, including validity period, eligible products, minimum order value and number of uses.
Unless otherwise stated:
- codes cannot be combined;
- they cannot be exchanged for cash;
- they must be entered before the order is completed;
- they cannot be applied retroactively.
Da Luz may refuse or cancel the use of codes obtained or used fraudulently or contrary to their respective conditions.
10. Payment Methods
The store may offer the following payment methods:
- MB WAY;
- Multibanco;
- credit or debit card;
- PayPal;
- other methods that may be displayed at checkout.
The availability of each method may vary depending on the country, device, order value or payment provider.
Payments are processed by specialised external entities. Da Luz does not receive or retain complete payment card details.
The order will be processed after payment has been confirmed, except for payment methods that operate differently.
Multibanco references and other payment methods with a payment deadline must be paid within the indicated period. Once this period has expired, the order may be automatically cancelled.
11. Order Preparation
Orders for available products are normally prepared within 1 to 2 business days after payment has been confirmed.
This period refers to order preparation and does not include transportation time.
Saturdays, Sundays, national holidays and public holidays applicable at the dispatch location are not considered business days.
During campaigns, holiday periods, product launches or periods of high demand, the preparation period may be longer.
Orders including pre-order products are subject to the period indicated on the relevant product pages.
12. Deliveries
Da Luz delivers to Portugal and other European countries, according to the destinations and delivery methods available at checkout.
Deliveries may be carried out through CTT, DPD or other carriers and logistics partners selected by Da Luz.
Available methods, costs and estimated delivery times are shown during checkout and may vary depending on:
- destination;
- order weight and dimensions;
- purchase value;
- carrier;
- delivery method;
- availability of collection points;
- customs procedures.
Transportation times are estimates. Delays may occur due to periods of high demand, weather conditions, strikes, customs procedures, recipient unavailability or other external circumstances.
For orders delivered to mainland Portugal, Da Luz offers free shipping on purchases of €60 or more, according to the eligible delivery methods displayed at checkout.
13. Collection Points
Where available, the customer may choose a collection point displayed at checkout.
The customer is responsible for confirming that the desired collection point has been selected and for providing correct contact details.
The order must be collected within the period communicated by the carrier and upon presentation of the required identification.
If the order is not collected within the specified period and is returned to Da Luz, the costs of a new shipment may be charged.
If the customer wishes to cancel the order after it has been returned due to failure to collect it, the legal rules regarding refunds shall apply, and costs legally attributable to the customer may be deducted.
14. Incorrect Address and Failed Delivery
The customer is responsible for the accuracy and completeness of the information provided.
If the order cannot be delivered due to an incorrect or incomplete address, the recipient’s absence or failure to collect the order, the customer may have to bear the costs of a new shipment.
Where provided for by the delivery service used, if the recipient is absent, the order may be redirected to a nearby collection point.
If you notice an error in the address, you must contact us immediately. We cannot guarantee that the address can be changed once preparation or dispatch has begun.
15. Order Inspection
The customer should check the external condition of the package at the time of delivery.
If the package shows visible damage, we recommend that you:
- report the damage to the carrier;
- take photographs of the package before opening it;
- keep the packaging and protective materials;
- contact Da Luz at geral@daluznatal.pt.
If the product is damaged, incorrect or incomplete, the customer should contact us as soon as possible, providing the order number and photographs that allow us to assess the situation.
This recommendation does not limit the consumer’s legal rights.
16. Right of Withdrawal
For distance contracts, consumers generally have 14 consecutive days to withdraw from the contract without giving any reason.
The period begins on the day on which the consumer, or a third party designated by the consumer other than the carrier, acquires physical possession of the goods.
To exercise this right, the consumer must send an unequivocal statement to geral@daluznatal.pt.
Where possible, the communication should identify:
- the customer’s name;
- the order number;
- the products the customer wishes to return;
- the date of receipt;
- the contact details associated with the order.
The consumer may use the statutory withdrawal form, although using it is not mandatory.
17. Return of Products
After communicating the decision to withdraw from the contract, the consumer must return the products within the statutory period of 14 days.
Before making the return, the consumer must contact us to receive the relevant instructions and confirm the applicable return address.
Unless Da Luz agrees to bear them or the law provides otherwise, the direct costs of returning the products shall be borne by the consumer.
Products must be returned complete and accompanied by any accessories, manuals, labels and packaging, where applicable.
The consumer may inspect the product with the care reasonably necessary to determine its nature, characteristics and functioning. However, the consumer may be liable for any decrease in value resulting from handling beyond what would normally be permitted in a commercial establishment.
The absence or deterioration of the original packaging does not automatically eliminate the right of withdrawal, but it may be taken into account if it has caused an actual decrease in the product’s value.
18. Refunds
In the event of a valid exercise of the right of withdrawal, all payments received will be refunded, including the cost of the least expensive standard delivery option offered for the order.
If the consumer chose a more expensive delivery option, the difference between that option and the least expensive standard delivery option will not be refunded.
The refund will be made using the same payment method used for the purchase, unless expressly agreed otherwise and provided that this does not result in any cost to the consumer.
Da Luz may withhold the refund until it has received the returned products or until the consumer provides proof that the products have been shipped, whichever occurs first.
The refund will be processed within the applicable statutory period.
19. Exchanges
Da Luz does not offer direct commercial exchanges of products.
If you would like a different item, size, model or reference, you may return the original product, provided that the legally applicable conditions are met, and place a new order.
This rule does not affect the consumer’s rights in the event of a lack of conformity of the product.
20. Defective or Non-Conforming Products
Products sold by Da Luz benefit from the legal guarantee of conformity applicable to consumer goods. Under the legislation currently in force, the seller is responsible for any lack of conformity that becomes apparent within three years from the delivery of the goods, without prejudice to any other legally applicable periods or rights.
If a product is defective, damaged for reasons not caused by the customer or does not conform to the contract, the consumer must contact us at geral@daluznatal.pt and provide:
- order number;
- product identification;
- description of the problem;
- relevant photographs or videos.
After assessment, the remedy provided for under applicable law will be offered. Depending on the circumstances and legal requirements, this may include repair, replacement, a proportionate price reduction or cancellation of the contract.
When the lack of conformity is confirmed, the costs necessary to restore conformity will not be borne by the consumer.
Normal wear and tear, improper use, accidents, negligence, incorrect storage or failure to follow the instructions for use do not constitute a lack of conformity attributable to Da Luz.
21. Order Cancellation
The customer must contact us immediately if they wish to cancel an order.
If the order has not yet been dispatched, we will try to stop its processing. However, we cannot guarantee that an order can be cancelled once its preparation has begun.
If the order has already been dispatched, the consumer may exercise the right of withdrawal after receiving it, in accordance with these Terms and applicable legislation.
22. Intellectual Property
The texts, photographs, graphic elements, logos, trademarks, design, layout and all other content on the Website belong to Mindscape, Lda., its licensors or their respective owners.
The user may access the Website and save or print content exclusively for personal and non-commercial use.
Without prior written authorisation, it is not permitted to:

30. Changes to the Terms and Conditions

31. Severability
If any provision of these Terms is deemed invalid, unlawful or unenforceable, that provision shall be limited or removed only to the extent necessary, and the remaining provisions shall remain in force.
32. Applicable Law and Jurisdiction
These Terms are governed by Portuguese law.
In the event of a dispute, the courts determined by the applicable legal rules shall have jurisdiction, without prejudice to the consumer’s right to refer the matter to the competent alternative dispute resolution entities.

Da Luz may withhold the refund until it has received the returned products or until the consumer provides proof that the products have been shipped, whichever occurs first.
The refund will be processed within the applicable statutory period.
19. Exchanges
Da Luz does not offer direct commercial exchanges of products.
If you would like a different item, size, model or reference, you may return the original product, provided that the legally applicable conditions are met, and place a new order.
This rule does not affect the consumer’s rights in the event of a lack of conformity of the product.
20. Defective or Non-Conforming Products
Products sold by Da Luz benefit from the legal guarantee of conformity applicable to consumer goods. Under the legislation currently in force, the seller is responsible for any lack of conformity that becomes apparent within three years from the delivery of the goods, without prejudice to any other legally applicable periods or rights.
If a product is defective, damaged for reasons not caused by the customer or does not conform to the contract, the consumer must contact us at geral@daluznatal.pt and provide:
- order number;
- product identification;
- description of the problem;
- relevant photographs or videos.
After assessment, the remedy provided for under applicable law will be offered. Depending on the circumstances and legal requirements, this may include repair, replacement, a proportionate price reduction or cancellation of the contract.
When the lack of conformity is confirmed, the costs necessary to restore conformity will not be borne by the consumer.
Normal wear and tear, improper use, accidents, negligence, incorrect storage or failure to follow the instructions for use do not constitute a lack of conformity attributable to Da Luz.
21. Order Cancellation
The customer must contact us immediately if they wish to cancel an order.
If the order has not yet been dispatched, we will try to stop its processing. However, we cannot guarantee that an order can be cancelled once its preparation has begun.
If the order has already been dispatched, the consumer may exercise the right of withdrawal after receiving it, in accordance with these Terms and applicable legislation.
22. Intellectual Property
The texts, photographs, graphic elements, logos, trademarks, design, layout and all other content on the Website belong to Mindscape, Lda., its licensors or their respective owners.
The user may access the Website and save or print content exclusively for personal and non-commercial use.

30. Changes to the Terms and Conditions
Da Luz may update these Terms to reflect legal, technical or commercial changes.
The version applicable to each order shall be the version published and in force at the time the order is placed.

If any provision of these Terms is deemed invalid, unlawful or unenforceable, that provision shall be limited or removed only to the extent necessary, and the remaining provisions shall remain in force.
32. Applicable Law and Jurisdiction
These Terms are governed by Portuguese law.
